DAY 1 (21 NOV): AD/AL or CADT/CALT REPRESENTATIVES VISITATIONS/DIALOGUES/DISCUSSIONS WITH THE CHAIRPERSON AND REPRESENTATIVES FROM LAO/ADO/OEHR/AS, CONCERNED NCIP REGIONAL:PROVINCIAL/CSC REPS AND CONCERNED AGENCIES OF GOVERNMENT
DAY 1– 21 November II Inter-Agency Community Visitation and Consultation to Resolve Burning Issues of ICCs/IPs at Cagayan de Oro City, Misamis Oriental.
The Indigenous Cultural Communities/Indigenous Peoples (ICCs/IPs) who participated for Day 1 are the Manobo Pulangiyon ICCs/IPs of Quezon Bukidnon, the Manngiwanhay Pulangiyen Tribal Association (MAPTA) Higaonon Pulangiyon, Matigsalug-Manobo ICCs/IPs (FEMMATRICS of CADT No. R10-KIT-0703-0011), Higaonon ICCs/IPs, Tacatcu-Palalan AD, ELSAHITRICO Claim of El Salvador, Kahito AD, Bae Panis CALT, UNIHITRICO AD, Nahilaran Dansolihon AD, all located within Bukidnon.
During the discussion, the following burning issues were raised and agreed upon:
*1. ELSAHITRICO AD CLAIM, EL SALVADOR*
• The following are the leaders of the AD:
a. Datu Ansilmo Bahian
b. Datu Nilo Akut
c. Hon. Datu Jesus F. Lundahay (KAHITO AD)
d. Bae Joy Mutya (KAHITO AD)
e. Datu Amay Tapurok Rommel Mansilao
According to the Higaonon ICCs/IPs of El Salvador, for the first time in their life, they were visited by someone from the NCIP. They expressed their utmost gratitude and excitement when they were visited by no less than the Chairperson of the National Commission on Indigenous Peoples together with multiple senior officials from the central office
The visit gave the Higaonon ICCs/IPs a candle of hope to finally be heard and resolve their issues. During the visitation, the following issues were raised by the Higaonon ICCs/IPs against Lorena Flores, Mariam Mahomadali, Naomi Pandi, Narciso Sagubay and other members of the community:
• That for almost 20 years, they have been neglected by NCIP despite the numerous invitations sent to NCIP personnel to visit their ancestral domain which is only 20 minutes away from Cagayan De Oro City.
• That NCIP refused to give COC to any members of the community without the proper validation processes. This is due to the alleged connivance of NCIP personnel and the LGU of El Salvador as they refused to recognize the existence of IPs in their area of jurisdiction.
• The AD Application of the Higaonon ICCs/IPs of El Salvador, Misamis Oriental was allegedly not entertained by NCIP Misamis Oriental PO and Initao CSC unless they pay a certain amount of money for processing.
• That according to the community, although they have been living in the area since time immemorial, existence of CALC, and was surrounded by Higaonon ICCs/IPs on all fronts, they are not being recognized as Indigenous Peoples by the City Local Government Units of El Salvador City thereby depriving their rights as Indigenous Peoples.
• As way forward, it was agreed that their ELSAHITRICO AD Claim’s application for CADT be refiled.
*2. Manobo-Pulangiyon AD located in Barangay San Jose and portion of Butong, Quezon, Bukidnon (Kianteg AD)*
• According to the report, there were two proposed relocation sites by the displaced Manobo-Pulangiyon ICCs. After much consideration, such as the proximity to road networks, the community chose the larger parcel of land for relocation. Moreover, they requested to fast track the processing of their CADT as it will ultimately solve their struggle.
• The leaders of this AD are the following:
a. Datu Rolando Anglao
b. Datu Danny Talisan
c. Bae Teresa Madulao Liwanag
d. Bae Luisa Anglao Torenio
e. Datu Wilson Anglao
• After discussing the said concerns, as a way forward, Provincial Officer Shirlene Sario shall communicate and seek the assistance of Quezon Bukidnon Mayor to facilitate the relocation of the said displaced community.
As regards the CADT application, it was agreed that the NCIP-Regional Office shall complete the compliance documents per the assessment of the Ancestral Domains Office as part of the recognition book by December 15, 2022. Moreover, Bukidnon PO committed to meet the ICCs/IPs on November 29, 2022.
*3. Manngiwanhay Pulangiyen Tribal Association (Mapta) Higaonon Pulangiyon*
• The issues regarding the intrusion of the Sayan Clan and the presence of the CPP-NPA were raised, which were discussed together with Provincial Officer Shirlene Sario.
•As ways forward, it was agreed that the delineation process of the MAPTA Higaonon Pulangiyon should be continued. Further, a report on the presence of CPP-NPA in the area should be submitted to the NCIP.
•The leader who raised the issue is Bae Naypillian Jenelyn Barcelona.
*4. Matigsalug Manobo AD*
• Datu Cosme Lambayon gave a discussion on the concept of COLO and Contract of Usufruct in relation to the Calom-Cadla guidelines in CADT No. R10-KIT-0703-0011.
*5. TACATCU-PALALAN AD- The leader is Datu Danilo Makapanton.*
• The issue raised relates to the conflict resolution among the four clans within the Tacatcu Palalan Ancestral Domain, which issue was discussed together with Acting PO Atty Jerie Marapao Ragsac.
• In the regard, Datu Makapanton explained the basis of his claim.
•As ways forward: For Datu Makapanton to submit a PPT of his claims. For RD Plaza and PO Ragsac to talk with Datu Makapanton and present to him proposed options on how to resolve the issues.
*6. UNIHITRICO AD*
• The leaders are the following:
a. Bae Dayan Dayan Vivian Tawakal
b. Datu Man-anbante Felipe Minister
c. Datu Kawilihan Benedicto Del Puerto
• The issues raised are: IPS validation of Teofilo Tawakal when there is an existing IPS/Tribal Council, Validation of IPS of Besigan by Lorena Flores, and Removal of Datu Del Puerto as tribal chieftain of Barangay Mambuaya.
• After discussing the issues with Acting PO Atty Jerie Marapao Ragsac and Lorena Flores, it was agreed that (ways forward):
a. For Bae Dayan Dayan to augment the NCIP with copies of her validation reports of her Tribal Council.
b. To set the revalidation of Besigan Tribal Council.
c. For NCIP to visit Brgy Mambuaya and set review their anthropological data.
*7.NAHILARAN AD*
• The leaders are:
a. Datu Makilala Roberto Cabaring
b. Datu Ruben Hagonao
• Issues raised are: Request for the issuance of a Certificate of Recognition, Request for fast-tracking of their Recognition Book, Presence of CBFMAs in the AD, and Fast-tracking of their EPR.
• After the issues were discussed with Acting PO Atty Jerie Marapao Ragsac, it was agreed that (ways forward):
a. To comply with the Recognition Book comments.
b. Hold a meeting with the DENR with respect to the CBFMAs in the AD.
